How cash advance loans works in practice

Where the advance is against a paycheque rather than a credit line, the product is regulated as payday lending, which brings the federal cost cap into play.
What drives the cost
For the paycheque-backed version, the regulated figure is the one that matters: federal regulations cap the cost of borrowing on a licensed payday loan at $14 per $100 advanced (Payday Lending Regulations SOR/2024-114), with a lower provincial cap prevailing where one exists.
For the credit-line version, the cost is the facility's own interest rate plus any advance fee, and there is normally no interest-free period. For the card version, the rate is typically higher than the card's purchase rate and applies from the day of the withdrawal.
All of it sits under the same outer ceiling: the criminal rate of interest is 35% per year (Criminal Code s. 347). That ceiling is calculated on an effective annual basis taking certain charges into account, so a modest headline rate with heavy fees is not automatically compliant.
How to choose between them
- Name the actual product before comparing. Two 'cash advances' can differ by an order of magnitude in cost.
- Check whether you already hold a cheaper facility. A line of credit you have not drawn on is usually the cheapest source of a short-term advance.
- Ask when interest starts. If there is no grace period, the effective cost is higher than the advertised rate suggests.
- Confirm every fee in writing. Advance fees, ATM fees and per-transaction charges all belong in the comparison.
